    The project focuses on reinforcing the performance efficiency and quality of the courts while at the same time strengthening the role of the HJPC BiH as the regulatory body for the judiciary of Bosnia and Herzegovina.

    The primary project objective is to reinforce the work of the courts by establishing a single budget & capital investment planning system for the courts, establishing an optimal systematisation of posts for judicial and non-judicial court staff, ensuring the ongoing application of the principles and instruments of the European Network of Councils for the Judiciary (ENCJ), improving the performance of the criminal departments and establishing a new draft regulatory framework with appropriate case processing deadlines. 

    All project activities use the adopted Reform Program as their basis as well as the findings of the Expert Report on Rule of Law issues in Bosnia and Herzegovina.

    PROJECT ACTIVITIES:


    1. Capacity building of HJPC
     
    1.1. Planning an adequate budgeting framework and support for the courts indrafting annual budgets

    The main objective of the activity is to improve the process for the preparation of court budgets in BiH based on actual needs. One step will be to establish an electronic database. This will facilitate easier data entry and processing as required for budget preparation by the courts, while the courts will receive the appropriate support for the establishment of an efficient annual budget development system aimed at setting up a single budget adoption method for all judicial institutions.

    1.2.  Capital investment in the judiciary

    Inadequate budget allocation for capital investments within the judicial institutions has a negative effect on the overall efficiency of the judiciary, and therefore the aim of this activity is to establish a system that will introduce system planning for capital investments in BiH courts and for building maintenance and furnishing. Standardised criteria for the preparation of capital investment plans will be established with the activity, while throughout the project,judicial institutions will receive advisory support for the preparation of general maintenance plans for court buildings.

    1.3.  Analysis of human resources at the courts

    This activity serves to develop a draft/analysis of the current situation together with court requirements for human resources which will serve as a future basis for the appointment of judicial office holders as well as for establishing the appropriate number of non-judicial staff members. Human resources are the most important item of any budget, which is why the focus of activities will be to establish an optimal systematisation of posts for judicial and non-judicial staff at the courts.

    1.4.  The continued application of ENCJ principles

    The general objective for this activity is to reinforce the regulatory role of the HJPC BiH as the guarantor of independence and accountability of the BiH judiciary through the application of standards of the European Network of Councils for the Judiciary (ENCJ). Activities are directed at strengthening the manage rial capacities of the HJPC BiH, the development of mechanisms for the appointment and promotion of judges,improving skills for Council members who interview candidates as well as the development of measures and mechanisms to combat inappropriate conduct and corruption. As part of this component, the HJPC BiH will also receive support in the development of an implementation plan for the Communication Strategy.

    2. COOPERATION WITH THE COURTS
     
    2.1.  Improving the performance of the criminal departments

    Activities are primarily directed at improving the performance quality of criminal departments at the courts as well as improving the efficiency of criminal procedures through stronger team work, the establishment of criteria and quality standards for the criminal departments, improving procedural discipline in presiding over criminal proceedings as well as establishing professional dialogue between the criminal departments of the first and second instance courts, all in cooperation with the pilot courts.

    2.2.  Sustainability of measures and results achieved aimed at greater efficiency and better court performance

    Ensuring continuity in the application of mechanisms and instruments that are developed as well as the continued development of the operations of the civil and criminal departments of the courts represent the primary elements of this part of the project. Certain activities will be directed at maintaining the results achieved together with the continued improvement of court performance through strengthened procedural discipline and the consistent interpretation of the provisions of the Civil Procedure Code, the establishment of cooperation mechanisms through professional dialogue between first and second instance courts, as well as by strengthening team work and the modus operandi of civil departments.

    2.3. Application of case processing timeframes at the courts

    The objective is to develop a new draft regulatory framework with case processing deadlines which would ultimately result in shorter average case processing times and increase the number of completed cases at the courts.
